Welcome to ViralSlides. These Terms of Service ("Terms") form a binding agreement between you ("Customer", "you") and ViralSlides ("we", "us", "the Service"). By creating an account, accessing the website, or using any part of the Service, you agree to be bound by these Terms. If you do not agree, please discontinue use of the Service.
1. The Service
ViralSlides is a software-as-a-service product that helps mobile app marketers generate TikTok-format slideshows, captions, hashtags, and calls-to-action. Features and limits vary by subscription plan. We may add, modify, or retire features over time; material changes will be communicated via email or in-product notice.
2. Eligibility and accounts
You must be at least 18 years old and legally capable of entering into a binding contract to use the Service. You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us immediately at security@viralslides.app if you suspect unauthorized access.
You agree to provide accurate registration information and keep it up-to-date. We may suspend or terminate accounts that violate these Terms or that contain materially false information.
3. Acceptable use
You agree not to use the Service to:
- Generate or distribute content that is unlawful, infringing, defamatory, harassing, hateful, or sexually explicit involving minors.
- Misrepresent your identity, impersonate any person or organization, or falsely imply endorsement.
- Attempt to gain unauthorized access to other accounts, computer systems, or networks connected to the Service.
- Reverse-engineer, decompile, or otherwise attempt to derive the source code of the Service except where allowed by law.
- Use the Service to build or train a competing product, or to benchmark for the purpose of public comparison without our written consent.
- Place excessive load on the Service, circumvent rate limits, or use automated tools beyond the bounds of your API plan.
4. Subscriptions, fees, and billing
The Service is offered through subscription plans described on the pricing page. Subscriptions auto-renew until canceled. Fees are billed in advance through our payment processor (Stripe). You authorize us to charge the payment method on file.
We may change pricing on at least 30 days' notice. If you do not accept a price change, you may cancel before the new pricing takes effect. Taxes are added where required by law.
5. Free plan and trials
The Free plan and any trial period are offered as-is and without warranty. We may modify or end Free plans and trials at any time. Quota consumed during a trial does not roll into a paid subscription.
6. Cancellation and refunds
You may cancel your paid subscription at any time through the Stripe Customer Portal. Cancellation takes effect at the end of your current billing period; we do not pro-rate. If you experience an issue within your first 7 days, email hello@viralslides.app and we will work in good faith to issue a refund.
7. Your content and our content
You retain ownership of the app metadata, brand colors, screenshots, and edits you upload to the Service ("Customer Content"). You grant us a worldwide, non-exclusive license to host, store, transmit, and display Customer Content solely to operate the Service.
We retain all rights, title, and interest in the Service, our hooks library, slide templates, and any software, copy, or trademarks we publish. Generated slides delivered to you are licensed to you for use in marketing the app(s) associated with your account.
8. Third-party services
The Service integrates with third-party providers such as Stripe, Cloudflare R2, MongoDB Atlas, and AI model vendors. Your use of the Service is also subject to those providers' terms. We are not responsible for the acts or omissions of third-party providers.
9. AI-generated output
Hooks, captions, hashtags, and calls-to-action are produced by machine learning models and may contain inaccuracies or stylistic choices that do not match your brand. You are responsible for reviewing all AI-generated output before publishing it.
10. Disclaimers
The Service is provided "as is" and "as available". We make no warranties, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee specific marketing results.
11. Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the greater of (a) the fees you paid to us in the 12 months preceding the claim or (b) USD 100. We are not liable for indirect, incidental, special, consequential or punitive damages, including lost profits or lost revenue.
12. Termination
Either party may terminate this agreement for any reason. We may suspend or terminate your account immediately if you breach these Terms or if we suspect fraud, abuse, or unsafe behavior. On termination, your right to access the Service ends; we will delete Customer Content within 30 days unless legal hold applies.
13. Changes to these Terms
We may update these Terms occasionally. Material changes will be announced by email or in-product notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
14. Governing law
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-laws principles. Any dispute will be resolved in the courts located in Istanbul, Türkiye, unless local consumer-protection law requires otherwise.
